Winter Haven, FL – An Uber driver fatally shot a man who threatened him while trying to stalk his girlfriend.

The shooting happened between Uber driver Robert Westlake and 34-year-old Jason Boek at about 2:20 a.m. Tuesday.

The incident started when a woman helped another woman who was intoxicated at a bar get an Uber ride home, according to WTVT-TV.

The women didn’t know each other. However, the woman helping the intoxicated woman was getting threatening messages from Boek.

After helping the intoxicated woman get an Uber, Boek’s girlfriend went back to the bar. However, Boek apparently thought his girlfriend got into the Uber, according to police.

Polk County Sheriff Grady Judd called Boek “explosive” and said he was stalking his girlfriend at the bar.

Boek texted his girlfriend he was going to chase the Uber driver and beat him up, according to WTVT.

In the video, a pickup truck cut off the Uber driver and pulled in front of him and forced Westlake to stop his car. Then Boek got out of his car and approached Westlake.

Westlake said, “I say something?”

Boek responded, “You know I got a pistol? You want me to f**king shoot you?”

Then a gunshot was heard.

A female passenger said, “Oh my god.”

Then Westlake repeated, “Oh my god.”

After shooting Boek, Westlake called 911 and tried to stop the bleeding and performed CPR on Boek, who was taking faint, shallow breaths, according to CNN.

Boek died at the scene.

"He ran me off road, jumped out of his vehicle," Westlake said in the 911 call, which was released by the police. "I couldn't get away. He came towards me, shouted he's got a pistol, reached for his waistband."

Police said that Boek did not have a gun but after threatening the Uber driver he was reaching for his cell phone.

Westlake told police he kicked the cellphone away and didn’t realize it wasn’t a gun at first.

Westlake is a security guard with a concealed weapon permit and had recently graduated from a police academy, according to WTVT.

"This is a justifiable homicide all day long," Sheriff Judd said, according to WTVT. "You have the right to protect yourself. This is a classic 'Stand Your Ground' case. This was the intent of the law.”

The intoxicated woman was still in the back seat at the time of the shooting. She was not connected to Boek or the woman who helped her get an Uber, Sheriff Judd said.

Boek had a criminal history that included arrests for aggravated battery, burglary, and drug charges. Boek also was driving his truck on a suspended license.

"Here's a message for the hotheads of the community: Don't do that stuff," Sheriff Judd said, according to CNN. "Good people carry guns and they will shoot you. A lot. Graveyard dead."

Sheriff Judd said that Westlake was cooperating with the investigation. He wasn’t initially charged but the investigation is ongoing.

Uber released a statement that said: "We are saddened by this unfortunate incident and will continue to work with police on their investigation."

Uber prohibits drivers and passengers from carrying firearms while using the Uber app “to the extent permitted by local law,” according to CNN.
