Muskogee, OK – The Muskogee Police Department has released bodycam footage that captured the moment a wanted fugitive pulled out a handgun while he was being arrested inside an Oklahoma bar (video below).

The incident occurred at the I Don’t Care Bar and Grill at approximately 2 p.m. on Nov. 12, after police received a report that a suspect with several outstanding warrants was inside the establishment, KFOR reported.

Andrew Richard Kana, 36, was wanted for domestic assault by strangulation, and also had three warrants out of Idaho for possessing a firearm after a felony conviction, domestic assault in the presence of a child, and assault and battery with a dangerous weapon, the Muskogee Phoenix reported.

Kana had additional charges pending in Payne County, Oklahoma for offenses of domestic assault and battery in the presence of minor children and carrying a concealed weapon, both of which were scheduled to go to trial early next year.

According to Tulsa World, the caller told dispatchers that Kana was in the restaurant with his ex-wife, who was the victim of the alleged strangulation offense.

Bodycam footage showed one of the officers as he raced into the restaurant to assist Muskogee Police Officer Ron Yates, who was holding onto a pair of handcuffs attached to Kana’s left wrist.

Officer Yates, who was holding Kana at gunpoint, told him to relax and was attempting to convince the suspect to surrender peacefully, KFOR reported.

“Sgt. Yates tried to persuade Kana to come outside peacefully,” Muskogee Police Officer Lincoln Anderson said in a press release, according to Tulsa World. “Kana stated, ‘You’re going to have to take me out.’”

Kana refused to surrender, and began to reach for a handgun.

“Don’t do it!” Officer Yates ordered. “Show me your hands!”

He then alerted his fellow officers that the suspect was armed, and rapidly fired three shots at Kana, the video showed.

The armed felon immediately fell to the floor.

“He’s got a gun, he’s got a gun,” Officer Yates said, as another officer rolled Kana onto his stomach.

Kana was pronounced dead at the scene, and his .380 caliber handgun was recovered from beneath the table where he collapsed, Tulsa World reported.

Investigators also located a magazine inside the gunman’s pocket during a pat down.

“I went in and he had this look on his face … I couldn’t see his hand,” Officer Yates said later in the video, according to Tulsa World. “I kept telling him ‘let’s don’t have a problem here, let’s don’t have a problem.’”

The veteran officer was visibly upset after the incident, KFOR reported.

“I just didn’t want to ever have to shoot anybody, chief,” he said through tears in the parking lot, according to the news outlet.

In addition to his outstanding warrants and pending cases, Kana had previously been convicted of possession of a firearm after a felony conviction, robbery with a dangerous weapon, child abuse by injury, and assault and battery with a dangerous weapon, the Muskogee Phoenix reported.

Officer Yates and two other Muskogee police officer have been placed on paid administrative leave pending the outcome of the internal investigation.
