Lebanon, OH – A teacher who got a four-year prison sentence for having sex with a student who asked how he could improve his grades has asked for an early release from prison.
Madalyn Arnett, 26, pleaded guilty to sexual battery involving a male student in March of 2019, according to the Dayton Daily News.
She was sentenced to four years in prison by Judge Timothy Tepe.
Prosecutors said that the student approached Arnett in class about what he could do to improve his grades. At first, Arnett would not help the student, according to the Dayton Daily News.
However, Arnett contacted the student on social media and began conversations that were sexual in nature. The teacher sent the student nude images and videos of herself, according to the Dayton Daily News.
Arnett picked up the student from his home on March 23, 2018 and had sex with the student in her vehicle. The incident was reported to the school and police were contacted.
Now, Arnett’s attorneys have requested an early release for their client.
The attorneys said that Arnett had achieved high marks while working as a food service worker and program aide while in prison, according to the Dayton Daily News.
“Ms. Arnett has a positive attitude” and has the support of her family and friends, the attorneys wrote in the motion.
“Ms Arnett has a permanent residence with family, and all of her family and friends reside in the area, including her three young children,” the motion stated, according to the Dayton Daily News. “Ms. Arnett plans on actively seeking work upon her release.”
Prosecutors are against allowing Arnett out early because the victim was 16 years old and the teacher used her position as an educator to commit the crime, the Dayton Daily News reported.
The judge will hear the motion on March 16.
